New definition of Photo Copyright Infringement - the Red Bus case
Photographers composing a photo similar to a previous composition may risk Copyright Infringement. You read correctly: this case is not about copying or stealing a photo, but about taking a similar photo.
In a case UK souvenir maker Temple Island Collection Ltd has now just won against New English Teas who used an image that look quite similar to the "original" one. The photo features a red bus in front of Londons iconic Big Ben - the colors and the contrast in both images is heavily manipulated.
Decide for yourself - the two images can be found over here and the full judgement can be found over there..
If you ask me: I think the square Big Ben clock makes the second photo a unique piece of art of its very own..=)
